He's been confirmed, unofficially.
In a video, they were displaying the sticker dealie, and in the bottom corner, when you highlight a sticker, whoever can use it has a little icon of their face. So on some stickers Ness, Jigglypuff and Lucario were seen (and yeah, it's Ness, not Pokemon Trainer, his is visibly different).
So Ness is in it.
As for the torrent, it seems to have stopped at 38%.
